Removal from the registers
OneSpirit maintains the right to remove any minister from the registers who is not complying with the MSR Governance Framework: Scotland. Section 16 of the framework sets out the grounds and the process, including the minister’s right to be heard. The grounds include lapse of ROSIM membership; lapse of a requirement such as residency, insurance or CPD that cannot be remedied within a reasonable period; loss of fit and proper standing; conduct contravening the not-for-profit requirement; misrepresentation of authorised status; a request from NRS; and the minister’s own request.
The Registrar General may also remove a celebrant from the register, or revoke a temporary authorisation, on the grounds set out in section 10 of the 1977 Act: for example, where the celebrant has been carrying on a business of solemnising marriages for profit or gain, or is no longer a fit and proper person.
OneSpirit has a duty to notify NRS within 21 days of any material change in a minister’s status: change of name, address or designation, retirement, death, lapse of membership, or any other reason a minister no longer holds, or no longer wishes to hold, authorisation. That is why your own duty to tell the nominators promptly matters.
